TERMS AND CONDITIONS – MRAKES GUESTHOUSE.

These Terms and Conditions govern all bookings, stays, events, and use of facilities at Mrakes Guesthouse, an overnight accommodation provider offering Guesthouse, Bed & Breakfast services, and event hosting. By making a booking, attending an event, or using our facilities, guests agree to be bound by these Terms and Conditions.

1. GENERAL CONDITIONS

1.1 Mrakes Guesthouse reserves the right to amend these Terms and Conditions at any time without prior notice.
1.2 Failure by Mrakes Guesthouse to enforce any provision shall not constitute a waiver of such provision.
1.3 These Terms are governed by the laws of the Republic of South Africa.

2. BOOKINGS & PAYMENTS

2.1 All bookings are subject to availability and confirmation by Mrakes Guesthouse.
2.2 A deposit or full payment may be required to secure a booking.
2.3 Payments must be made by the agreed method and within the specified timeframes.
2.4 Mrakes Guesthouse reserves the right to cancel any booking if payment terms are not met.

3. CANCELLATIONS, NO-SHOWS & REFUNDS

3.1 Cancellation policies will be communicated at the time of booking.
3.2 No-shows may be charged 100% of the booking value.
3.3 Refunds, if applicable, are processed at the discretion of management and may be subject to administrative fees.
3.4 Mrakes Guesthouse shall not be liable for refunds due to circumstances beyond its control, including but not limited to weather, power outages, or acts of God.

4. CHECK-IN & CHECK-OUT

4.1 Check-in and check-out times are strictly enforced unless prior arrangements are made.
4.2 Early check-in or late check-out may incur additional charges.
4.3 Failure to vacate the room on time may result in extra charges.

5. GUEST RESPONSIBILITIES

5.1 Guests must behave in a respectful and lawful manner at all times.
5.2 Any damage, loss, or excessive cleaning required due to guest actions will be charged to the guest.
5.3 Mrakes Guesthouse reserves the right to evict guests without refund for misconduct, excessive noise, illegal activities, or violation of these Terms.

6. LIABILITY & DISCLAIMER

6.1 Guests enter and use the premises at their own risk.
6.2 Mrakes Guesthouse, its owners, employees, and agents shall not be held liable for:

  • Personal injury, illness, or death

  • Loss, theft, or damage to personal belongings

  • Vehicle damage or theft

  • Power outages, water interruptions, or internet failure

  • Noise disturbances beyond reasonable control

6.3 Guests are advised not to leave valuables unattended.
6.4 Parking is provided at guests’ own risk.

7. EVENTS, FUNCTIONS & VENUE HIRE

7.1 Event organisers are fully responsible for the conduct of their guests and service providers.
7.2 Mrakes Guesthouse is not liable for:

  • Injury, loss, or damage during events

  • Third-party service failures (e.g., caterers, decorators, entertainers)

  • Noise complaints arising from lawful events

7.3 Event organisers may be required to sign a separate event agreement and indemnity form.
7.4 Mrakes Guesthouse reserves the right to stop or cancel any event that poses a safety risk or violates laws or community regulations.

8. FORCE MAJEURE

8.1 Mrakes Guesthouse shall not be held liable for failure to perform obligations due to events beyond its control, including but not limited to:

  • Natural disasters

  • Load shedding

  • Government regulations

  • Strikes or civil unrest

  • Pandemic-related restrictions

9. HEALTH, SAFETY & SECURITY

9.1 Guests must comply with all safety instructions and signage.
9.2 Children must be supervised at all times.
9.3 Mrakes Guesthouse is not responsible for accidents resulting from negligence or failure to follow safety guidelines.

10. PETS & SPECIAL REQUESTS

10.1 Pets are only allowed with prior approval and may be subject to additional terms.
10.2 Special requests are not guaranteed and are subject to availability.

11. PRIVACY & DATA PROTECTION

11.1 Guest information is collected for booking and operational purposes only.
11.2 Mrakes Guesthouse will not sell or misuse personal information and complies with POPIA requirements.

12. RIGHT OF ADMISSION RESERVED

12.1 Mrakes Guesthouse reserves the right to refuse admission or services to any person without obligation to provide reasons, provided such refusal complies with South African law.

13. INDEMNITY

13.1 Guests and event organisers indemnify and hold harmless Mrakes Guesthouse against any claims, damages, losses, or legal costs arising from:

  • Their actions or omissions

  • Actions of their guests or contractors

  • Breach of these Terms and Conditions

14. ACCEPTANCE OF TERMS

By confirming a booking, attending an event, or using the facilities of Mrakes Guesthouse, guests acknowledge that they have read, understood, and agreed to these Terms and Conditions.
